which came into force earlier this year, and represent the biggest change to oil
storage requirements in Scotland for many years.

The new Regulations apply to any kind of oil including petrol, diesel, mineral oil,
heating oil, lubricating oil, waste oil, vegetable and plant oil. Whilst similar in
some respects to The Control of Pollution (Oil Storage) (England) Regulations 2001,
the Scottish regulations also cover the storage of Agricultural Fuel Oil. Previously
agricultural installations fell within the remit of The Control of Pollution
(Silage, Slurry and Agricultural Fuel Oil) (Scotland) Regulations 2003. Waste oils
also fall within the remit of the Regulations, unlike in England, where the storage
of waste oils is specifically excluded.

All new installations in Scotland (i.e. any installation commenced after 1 April
2006) must comply with the new Regulations by 1 October 2006. Existing \'at risk\'
installations (i.e. facilities that are located within 10 metres of any surface
water or 50 metres of a borehole or well) will have to comply by 1 April 2008. And
all other remaining installations that fall within the remit of the Regulations must
comply by 1 April 2010.

Domestic installations with an installed capacity of less than 2,500 litres are not
covered by the Regulations, but new or altered oil storage installations, should
comply with the requirements of The Building (Scotland) Act 2003.
